These terms apply when you use Chefy, whether you are ordering meals, running a kitchen, or delivering orders. By placing an order or creating an account you agree to them.
What Chefy is
Chefy is a platform that lets independent chefs publish a weekly menu, take orders, and arrange delivery. The chef prepares your food, not Chefy. We provide the ordering, payment and tracking technology. Your agreement for the meals themselves is with the chef you order from.
Orders and prices
- Menus are set weekly by each chef and may change or sell out.
- Prices are shown in Kenyan Shillings (KSh) and include the delivery fee shown at checkout.
- Delivery is priced by road distance between the chef's kitchen and the drop-off point you select, so picking an accurate location on the map matters.
- An order is confirmed once payment succeeds. Until then it stays pending and is not prepared.
Payments, payouts and settlement
Payments on Chefy are processed by our payment provider, Paystack. Chefy never receives or stores your card or bank details. When you pay for an order, the amount is split between the parties entitled to it at the point of payment, as set out below. If a payment fails or is later reversed, the chef is not obliged to prepare or deliver the order.
How each order is settled
- Chefs (food). Each kitchen is set up with its own payment provider subaccount linked to the chef's own bank account. The price of the food, less Chefy's commission, is settled directly to the chef by Paystack at the time of payment. Chefy does not receive, hold, or take custody of a chef's food revenue at any point.
- Chefy (commission). Chefy retains a commission, charged only on the food portion of an order, as its fee for providing the ordering, payment and delivery-coordination platform. This is Chefy's own revenue.
- Delivery. The delivery fee is Chefy's charge for arranging delivery of the order. It is Chefy's own revenue, received to pay for the delivery service — it is not money held on behalf of anyone else.
Driver earnings
Drivers deliver as independent contractors engaged by Chefy. When a delivery is completed and confirmed with the customer's delivery code, Chefy records the delivery fee as earnings owed to that driver. A driver's “Earnings” balance is simply a running record of amounts Chefy owes the driver for deliveries completed, and is paid out to the driver's nominated account on a regular basis.
This earnings balance is not a wallet, stored value, or electronic money. Drivers cannot pay funds into it, cannot hold or accumulate a balance in it for future payments to third parties, and cannot spend or transfer it to anyone else. It functions solely as a payroll-style record of earnings for completed work.
No escrow
Chefy does not operate an escrow service and does not hold customer funds in trust pending the outcome of a transaction. Money you pay is either settled directly to the chef by Paystack (the food, via the split above) or received by Chefy as its own revenue (its commission and the delivery fee). Refunds, where agreed, are processed back through Paystack to your original payment method.
Delivery
- Provide an address and map pin you can actually receive food at, and a phone number that is reachable.
- You will receive a tracking link, and a delivery code to give the driver at hand-over.
- Delivery windows are estimates. Traffic, weather and demand can move them.
- If nobody is available to receive a delivery and the driver cannot reach you, the order may be treated as completed without a refund.
Cancellations and refunds
Because meals are cooked fresh to order, an order can normally only be cancelled before the chef starts preparing it. If your food does not arrive, arrives in poor condition, or is materially different from what you ordered, contact the chef using the number on your tracking page. Refunds are agreed with the chef and processed back through the original payment method. Chefy can help mediate but is not the seller of the meals.
Reviews
You may leave one review per delivered order. Keep reviews honest and about your own experience. We may remove reviews that are abusive, defamatory, or clearly not based on a real order.
If you run a kitchen on Chefy
- You are responsible for food safety, hygiene and holding any licences or permits Kenyan law requires.
- Describe your meals accurately, including anything a customer with allergies would need to know.
- Keep your menu, prices and kitchen location up to date.
- You provide a bank account for your payouts. Chefy links it to a payment-provider subaccount so your food revenue, less commission, settles directly to you. You confirm the account belongs to you and that the details are correct.
- Use customer contact details only to fulfil that customer's order, never for marketing without their consent, and never share them onward.
If you deliver on Chefy
- You deliver as an independent contractor, not an employee of Chefy. You are paid the delivery fee as earnings for each delivery you complete, paid out to your nominated account on a regular basis.
- Deliver only to the assigned customer, and confirm hand-over with the customer's delivery code.
- You provide a payout account for your earnings and confirm the details are correct. Your earnings balance is a record of what Chefy owes you for completed deliveries; it is not a wallet you can pay into or spend.
- Location sharing is yours to control. When it is on, the customer sees your live position for their delivery only; you can switch it off at any time.
- Follow all traffic laws. Never use the app while riding or driving.
Acceptable use
Do not attempt to access accounts, orders or kitchens that are not yours, disrupt the service, scrape it, or use it for anything unlawful. We may suspend accounts that do.
Allergies and dietary requirements
Meals are prepared in kitchens that handle many ingredients, so we cannot guarantee any dish is free from a given allergen. If you have a serious allergy, check with the chef directly before ordering.
Liability
We provide the platform “as is” and do our best to keep it running, but we do not guarantee it will always be uninterrupted or error-free. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, Chefy is not liable for the quality or safety of food prepared by a chef.
Ending your use
You can stop using Chefy at any time and ask us to close your account. We may suspend or close an account that breaches these terms.
Changes
We may update these terms. The date at the top shows the current version, and continuing to use Chefy after a change means you accept it.
Governing law
These terms are governed by the laws of Kenya, and the Kenyan courts have jurisdiction over any dispute.
